This is an appeal from grant of summary judgment 1 for defendant against a tort claim arising out of an industrial accident. Plaintiff admittedly received workmen’s compensation benefits for the accident from the insurance carrier of third-party defendant Employers Temporary Service, so the only issue before the court below and on this appeal is whether defendant Higgins Co. was an “employer” of plaintiff within the meaning of the workmen’s compensation laws so as to make plaintiff’s recovery under those laws exclusive, CL 1948, §411.4 (Stat Ann 1968 Rev §17.144), thus barring this suit…
