At Exa Labs, your privacy is important to us. This Privacy Policy explains how we, Exa Labs Inc., collect, use, disclose, store, and protect your personal information when you interact with and use our website (https://exa.ai), applications, services, tools and features, including our search engine, search API and websets tool (collectively, the "Services"). This Privacy Policy does not apply to content or other information that we process on behalf of customers of our business offerings, where we act as a processor or service provider to our business customer. Our processing of that information is governed by the relevant customer agreements covering access to and use of those offerings.

In many instances, our Services are designed to return publicly available data in response to your queries. Although publicly available data is not considered "personal information" under certain data privacy laws, we have nevertheless described how we collect, use and disclose such information in this Privacy Policy, so that you have an understanding of our data related practices.

By using our Services, you agree to the collection and use of your information in accordance with this Privacy Policy. If you do not agree with the practices described herein, please do not access or use our Services.

Information Collection and Use

When you use or access the Services, we collect certain categories of information about you from different sources. In addition to the specific uses discussed below, we may use this information to provide and improve the Services and to maintain our business relationship, including by enhancing the safety and security of our Services, providing customer support, complying with applicable legal obligations, enforcing any applicable terms of service, and protecting our rights and the rights of our employees, users or other individuals.

Information You Provide to Us

Some features of the Services may require you to directly provide certain information, including information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

  • Contact information, such as your name, email address and organization. We use this information to create and maintain your account, provide the Services and to communicate with you (including to tell you about products or services that may be of interest to you.
  • Account information, such as username, password, account preferences and other information you add to your account or profile. We use this information to provide the Services and to create, maintain and secure your account with us. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.
  • Payment and subscription information, such as credit or debit card information, and billing address, which is collected on our behalf by our payment processor, and information about your subscription tier and transaction history. We use this information to process your payment and provide the Services, and to provide you with different account features and options.
  • Any other information you choose to provide us or otherwise include in communications with us, for example, when sending a message through the Services.
Query Data

Our AI-powered Services contain open text query fields that are designed for submitting informational search queries ("Query Data"). These fields are not intended for the submission of personal information. While our query fields are open text fields that could technically accept any input, we do not intend to collect personal information through queries and you should not input personal information in these fields or submit any personal information as Query Data.

Please note:

  • We do not actively monitor query data for personal information
  • Query Data is used to improve our products and technology, including by training and fine-tuning models that power our Services
  • For submitting personal information to us, please use only the designated business contact fields or contact methods specified elsewhere in this Privacy Policy.
Information Collected Automatically

We and third parties also automatically collect certain information about your interactions with the Services, including through cookies, pixels or other tracking technologies. This information is collected and used to better understand user interactions with the Services, run analytics, monitor and improve performance, measure engagement and to tailor and enhance user experience. Such information includes:

  • Device information, such as device type, operating system, unique device identifier, and internet protocol (IP) address.
  • Location information, such as approximate location based on IP address.
  • Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, clickstream data (e.g., page requests, page views, how much time is spent on a page, content viewed or interacted with, text entered, etc.), interactions with marketing emails.

Information Collected From Other Sources

We may obtain information about you from outside sources, including information that we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

  • Information we receive when you choose to access the Services through your email account or another third party service, such as from Google. We use information received from these partners, including your name, email address and profile picture, to maintain your account and login information.
  • Information we receive from data partners and data enrichment companies, including which we use to power our Services, including to generate more informed content in response to your queries.
  • Information from publicly accessible sources, including names, job titles, company affiliations and other information that is publicly available online (e.g., from articles, journals, websites, online directories) or from other public sources. We use this information to provide and improve our products and technology, including by generating content in response to queries and training and fine-tuning models that power our Services.
  • Information we receive directly from third party social media platforms, such as when you interact with us on LinkedIn, X or Discord, which we use to communicate with you and personalize our Services.

Any information we receive from outside sources will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. Deidentified Information

Finally, we may deidentify, anonymize or aggregate your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (or we may collect information that has already been deidentified, anonymized or aggregated), and we may use such information for any lawful purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified form and not attempt to reidentify the information, except solely for the purpose of determining whether our deidentification process satisfies legal requirements.

Cookies and Other Tracking Technologies

As described above, we use cookies and other tracking technologies to collect certain information and understand how you interact with our Services, and to enhance your experience. Most browsers accept tracking technologies automatically, but you may be able to control the way in which your devices permit the use of certain technologies. If you so choose, you may block or delete certain cookies or tracking technologies from your browser; however, blocking or deleting cookies may cause some of the Services, including login features and general functionality, to work incorrectly.

Your browser settings may allow you to transmit a "Do Not Track" signal when you visit various websites. Like many websites, our website is not designed to respond to "Do Not Track" signals received from browsers.

Disclosure Of Your Information

We may disclose your information for legitimate purposes subject to this Privacy Policy, including:

  • Vendors or other service providers who help us provide the Services, including for cloud storage, security, customer communications and relationship management (including customer support and marketing platforms), analytics, payment processing and the deployment of Tracking Technologies.
  • Our affiliates or others within our corporate group, to efficiently provide the Services.
  • Professional advisors, such as auditors, law firms, or accounting firms, to assess, protect, enforce and defend our rights and to comply with our legal and regulatory obligations.
  • Third parties in connection with or anticipation of an asset sale, merger, bankruptcy, or other business transaction.
  • For legal and security reasons and to protect our services and business, including to cooperate with law enforcement, judicial orders, and regulatory inquiries, to detect and prevent against fraudulent or illegal activity, to exercise or defend legal claims, to ensure the safety and security of our business, employees, and users, and to enforce our terms or other agreements.
  • With your consent, or when you otherwise request or direct us to disclose your personal information.

Our Services are designed to make content available to you and other customers in response to Query Data. We therefore also disclose certain content to customers through their use of our Services, which customers may use for their own purposes.

Social Features

Certain features of the Services allow you to initiate interactions between the Services and third-party services or platforms, such as Discord, GitHub and social networks ("Social Features"). Social Features may include features that allow you to access our pages on third-party platforms, and from there to engage with, "like" or "share" our content. Use of Social Features may allow a third party to collect and/or use your information. If you use Social Features, information you post or make accessible may be publicly displayed by the third-party service. Both we and the third party may have access to information about you and your use of both the Services and the third-party service. Third-Party Websites and Materials

We may provide links to third-party websites or platforms, and display, or make available content, data, applications or materials from third parties. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms, or the accuracy, completeness or reliability of third-party materials. Information you provide on public or semi-public venues, such as third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

Children's Privacy

Our Services are not intended for children, and we do not seek or knowingly collect any personal information about children. If we become aware that we have unknowingly collected information about a child, in particular any child under 13 years of age, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

Security

The security of your personal information is important to us. We employ appropriate technical and organizational measures designed to protect your information from unauthorized access, use, alteration, or disclosure. However, no security measures are impenetrable, and we cannot guarantee "perfect security". Any information you send or transmit electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.

We reserve the right to modify this Privacy Policy at any time, in which case we will update the "Last updated" date at the top of this Privacy Policy. If we make material changes to how we use or disclose information, we will use reasonable efforts to notify you and any additional steps as required by applicable law.
