1 Reported in 265 N.W. 347. Defendant appeals from the order denying a new trial after findings that plaintiff had acquired a prescriptive road across defendant's land and enjoining defendant from obstructing it.

Plaintiff since 1907 has owned the east half of the southeast quarter of section 33 in the town of North Branch, Isanti county. Since 1910 the land has been his homestead, the buildings being near the northwest corner thereof.
