The facts are as follows:
The land in controversy was conveyed to the Duluth Transfer Eailway Co. for right of way purposes, by the executors of the estate of George' W. Norton, deceased, who was the owner of the larger tract out of which the land in question was taken. The grantee in that conveyance was a corporation duly organized under the laws of the state in the year 1890, for the purpose of operating transfer lines of railroad within the city of Duluth…
