Plaintiffs, husband and wife, brought suit to recover damages for personal injuries sustained by the wife, a pedestrian, when struck by an automobile driven by defendant Freddie Steele. At the conclusion of plaintiffs’ case, tried before a jury, defendants moved for dismissal of the action on the ground that it appeared from the evidence that the pedestrian wife was guilty of contributory negligence as a matter of law.
