Plaintiff brought this action under the constitutional provision to recover compensation for damage done by the state to plaintiff’s.track, which resulted from the construction of a state highway. The damage complained of occurred along a stretch of two miles at the base of Chuckanut mountain, a few miles south of Bellingham.
