DECISION AFTER NON-JURY TRIAL AND POST-TRIAL BRIEFS
QUILLEN, Judge:
This is the Court’s opinion after a non-jury trial held on July 25, 1995. The burden of proof is, of course, on Wayne Jody Gray, the plaintiff. I will refer to Perry Peterson, the driver of the motor vehicle, as the “insured.” The relevant insurance is the no-fault benefits under the insured’s policy with Allstate Insurance Company, the defendant.
