This is an appeal from an order granting a new trial. The plaintiff, out of possession, brought an ordinary action to quiet title. The defendants Ramont, husband and wife, answered, alleging ownership in fee simple, possession and right of possession in themselves, and set up certain proceedings under sales for delinquent taxes, whereby they claimed to have acquired title to the property. The cause was tried with a jury. The only special issue requested was refused by the court, and the jury returned a general verdict “for the plaintiff.” No findings were made, and the only judgment entered…
