This is an appeal from a judgment restrain ing the sale of plaintiffs’ property under an execution issued on a judgment rendered in the case of Edward Rainey, Superintendent of Banks of the State of California v. Clarence C. McIntosh and Metta McIntosh. Plaintiffs have moved to dismiss this appeal. Defendant Shay is sued in his official capacity as Sheriff of San Bernardino County. Hereafter we will refer to Elias Shahen as the defendant.
