The plaintiff in his complaint sets forth a number of causes of action. They involve the validity of a sheriff’s sale of certain real property known as the 11 Ruby Mines”, situate in Sierra County, and couples therewith a count asking for the return of between $3,500 and $4,000 alleged to be the excessive amount which the plaintiff was compelled to pay in order to secure a redemption of the property from the sale thereof made by the sheriff.

The record shows that preceding the sale of the property five judgments had been obtained against the Ruby Mining Company, and executions thereon issued…
