This was a proceeding to enjoin the collection of certain paving assessments levied by the town of Bixby, through its board; of trustees. The legality of th.e assessment was attacked upon two grounds: (11 Because the statute, chapter 17C, S. L. 1919, under which the paving in question was done, is unconstitutional. (2) If such statute is valid, then the paving in question was not done, nor the assessments levied, in compliance with said statutes, and were illegal.
