This matter was originally heard in conciliation court, resulting in judgment in favor of respondent-homeowners. At the trial following removal to the district court, the district court initially directed a verdict in favor of appellant-homebuilder. Immediately thereafter, the district court vacated the directed verdict, received further testimony, finished the trial, and dismissed respondents’ claim.
