This case arises out of the Adams County District Court’s dismissal of a felony theft charge brought against Gary Lee Johnson (Johnson). The dismissal was based upon the People’s failure to bring Johnson to trial within the time limitation period contained in the Interstate Agreement on Detainers (the IAD), §§ 24-60-501, to -507, 10B C.R.S. (1988). The People filed an appeal with the court of appeals which reversed the district court’s decision in People v. Johnson, 926 P.2d 126, 130 (Colo.App.1996).
