The plaintiffs, Howard B. Sosin and Susan F. Sosin, appeal from a partial judgment2 of the trial court dismissing four counts of their five count complaint, which alleged breach of a construction contract between the plaintiffs and the defendants, Robert D. Scinto, Barbara A. Scinto (defendants) and R. D. Scinto, Inc. (corporate defendant).
