J. W. Collins commenced this action to recover damages for personal injuries alleged to have been received while an employee of the Texas Company, due to the negligence of said company. It was charged that on the 9th day of .September, 1910, Collins, being an employee of the Texas Company, was placed tó work on a skeleton platform which was being erected at the base of an oil tank; that this platform was some five or six feet from the ground, and not floored, but loose boards were placed on the top thereof, and was an unsafe place to work; that he was directed to screw…
