This is an appeal from the superior court of Oklahoma county. On August 25, 1910, the defendant in error, hereinafter referred to as the “plaintiff,” commenced this action in the superior court of Oklahoma county, against the plaintiff in error, as the administrator of the estate of Maggie E. Fay, deceased, hereinafter referred to as the “defendant,” to- recover $1,250, with interest at 6 per cent, from May 26, 1910, as commission for procuring a purchaser for certain real estate belonging to the deceased.
