This is an action by plaintiff in error, plaintiff below, against defendant in error, defendant below, in 'damages for personal injuries alleged to have been sustained by plaintiff as a result of the negligence of defendant. After answer filed, in effect, a general denial, plea that plaintiff assumed the risk of the employment and contributory negligence, there was trial to a jury. At the close of the testimony the court, on motion, instructed the jury to return a verdict for defendant, which was done. Plaintiff brings the case here and assigns this for error.
