The question involved in this case is whether the trial court erred in denying a petition for a new trial on the ground of newly discovered evidence, filed after the term at which the judgment was rendered.
Bowmaker, the defendant in error, plaintiff below, brought this action against Lookabaugh, the plaintiff in error, defendant below, to cancel a mortgage alleged to have been procured by fraud.
