The present action was instituted by the plaintiff in the court below on the 19th day of September, 1911, to recover damages on account of personal injuries alleged to have been sustained by him in falling from the roof of a barn being constructed by one Johnson and the defendant, Philip Carey Company, for the use of the State Agricultural and Mechanical College, at Stillwater, Okla., on the 7th day of July, 1910.
