K. D. Bernard, plaintiff, instituted this action in the district court of McIntosh county on the 15th day of September, 1917, against Robert McRay, defendant, to establish a trust agreement and to require the defendant to deed to the plaintiff an undivided one-half interest in 160 acres of land situated in McIntosh county described in plaintiff’s petition. The cause was tried on the 20th day of February, 1919, to Honorable R. W. Higgins, district judge. The evidence introduced on behalf of the respective parties to the action was conflicting upon the issue of their having a trust agreement.…
