Error from Leavenworth District Court. At the December Term, 1881, of the district court, Lamb, as plaintiff, recovered a judgment against defendant, Sexton, who brings the case here. The opinion states the facts.

This case is an outgrowth of the one just decided, and comes to us from a ruling of the district court, on a petition filed for a new trial. It appears that the judgment in the case just decided was rendered on the 15th day of January, 1881, and this petition for a new trial was filed on the 1st day of November, 1881. The petition alleges that the judgment was obtained by false and incompetent testimony, and that the petitioner has since discovered new and important testimony, which, if introduced upon another trial, would compel a different…
