This case presents error from the district-court of 'Kingfisher county. October 7, 1907, defendants in error as plaintiffs filed their petition in the district court to recover of and from defendant, plaintiff in error in this court, actual damages in the amount of $642.37, and exemplary damages in the sum of $1,000.00, which said damages are alleged to have grown out of the sale by defendant to plaintiffs of hogs infected with cholera.
