This appeal is by the plaintiff from a judgment entered upon an order sustaining the defendants’ demurrer to the plaintiff’s amended complaint without leave to amend. The action was one commenced by the plaintiff on his own behalf and also as the assignee of one A. M. Johnson, who prior thereto had assigned and transferred to said plaintiff all of his right, title, and interest in the claim and demand which formed the basis of said action.
