The action is brought to recover the reasonable value of services alleged to have been rendered, as attorney and agent, by plaintiff, for the said Joséfa Loureyro in her lifetime. The case was tried without a jury, and the defendant appeals from a judgment rendered in plaintiff’s favor and from an order denying his motion for a new trial.

The plaintiff presented his verified claim against the estate of said Loureyro, deceased. The material part of said claim reads as follows: —

“ Estate of Joséfa Loureyro, Deceased.
“ To C. A. Thompson, Dr.
“For the value of services rendered by claimant…
