This unusual action combines a pre-award bid protest with a claim for damages under the Contract Disputes Act, 41 U.S.C. §§ 601-613. At issue is a contract between the United States Department of Interior, Bureau of Reclamation (the “Department”), and the Montana Fish, Wildlife, and Parks Foundation (the “Foundation”) for the administration of the Montana Fish and Wildlife Conservation Trust (the “Trust”).
