In an action for declaratory relief, plaintiffs, as owners of land (the servient tenement) adjoining that of defendants (the dominant tenement), sought to have the court construe a parking lot agreement between the parties so as to permit the construction of an automobile service station on plaintiffs’ property. The area comprising the land is part of a retail shopping center in the San Fernando section of Los Angeles.
