Is an action seeking underinsured motorist coverage, which coverage pursuant to statute is provided for all sums which the insured shall be legally entitled to recover as damages from the owner or operator of an underinsured motor vehicle because of bodily injury or property damage, barred by the personal injury statute of limitations, when such action against the tortfeasor is filed after the expiration of the limitations period, following settlement with and release of the…
