In an action for personal injuries by Robert C. Brown against Alden L. Bertrand, a judgment for $12,000 was entered for plaintiff on December 28, 1951, pursuant to a stipulation of settlement. Subsequently, a garnishment summons was served upon Western Casualty & Surety Company, appellant herein. It then disclosed that it was under no indebtedness to defendant. On March 27, 1953, a supplemental complaint was served upon it by plaintiff in the original action.
