This is an appeal by the plaintiff from a judgment in favor of the defendants in an action to recover damages in the sum of fifty thousand dollars for the death of one Charles Perry Whitaker. In the early part of 1917 Whitaker was employed by Isaías W. Heilman as manager of the I. W. Heilman Building, in the city of Los Angeles. Appellant had issued to Heilman a policy of insurance against liability for injuries received by his employees under the Workmen’s Compensation, Insurance and Safety Act (Stats. 1917, p. 831).
