This is an action by the mother of two minor children, Albert Pierce and Walter Pierce, the father being dead, to recover damages for the death of said children, which is alleged to have been caused by the negligence of the defendant. The jury gave a verdict in favor of plaintiff, fixing the damages for the death of Albert at $4,900, and for the death of Walter at $5,100. A motion for a new trial being made, the trial court ordered a new trial unless plaintiff con sented to a reduction of the judgment to $1500 for the death of Albert and $2500 for the death of Walter, an aggregate of $4000.…
