THE COURT.
Plaintiff brings this action for personal injuries received by him on April 23, 1927, when the elevator he was employed to operate in the Wilson Building in San Francisco fell by reason of a broken hoisting shaft. Plaintiff’s employer at that time was the Wilson Estate Company, the owner of the building, for whom plaintiff had been working in the capacity of elevator operator for several years before the date of the accident.
