This is the second time this case has been in this court. At first it was brought here to review the action of the district court in sustaining a demurrer to the plaintiff’s evidence. (Jansen v. The City of Atchison, 16 Kas. 358.) The ruling of the district court at that time was reversed, and it was decided that there was a question of fact which, so far at least as the present parties are concerned, ought to be submitted to a jury. A second trial was had, which resulted in a judgment in favor of Jansen for the sum of $1,000, and from such…
