Defendant was convicted in the district court of Atchison county of the crime of murder in the second degree, and sentenced to the penitentiary for a term of ten years. From that conviction and sentence he has appealed to this court. The errors complained of may be grouped into four classes: first, objection to the sufficiency of the information; second, error in the instructions; third, the giving of an oral instruction; fourth, refusing to receive the verdict as prepared by the jury, and preparing a verdict for them to return.
