Defendant was found guilty of murder in the second degree and appeals, specifying fourteen assignments of error.

John Eelien Jones had four grown sons. With his wife he had *274lived on a small farm near Arkansas City. His wife died six or seven months before the homicide occurred. In 1928 Elsie Jones brought suit for divorce against the defendant, and she was given the home place, which she mortgaged for $2,500, which defendant received.
