The plaintiff in its petition in the court below alleges that the note sued upon was executed by the defendant to the Morrison Brothers Mill aDd by the said payee indorsed and transferred in due course to the plaintiff. The answer admits the execution of the note, hut pleads a lack of consideration and that the plaintiff is not a holder in due course.
