ANDERSON, PAUL H., Justice.

Appellant Mark James Olson was charged with third-degree assault and qualified for the services of a public defender. Olson requested public funding for a toxicology expert and investigative services under Minn.Stat. § 611.21(a) (2000). The district court denied funding for the expert and for investigative services. Olson took an immediate appeal under Minn.Stat. § 611.21(c) (2000). The court of appeals affirmed the district court on the issue of expert funding, but did not address funding for investigative services on the grounds that the issue was not…
