Appellant by this appeal questions the validity of an order appointing a receiver pending the determination of a suit brought by him against his divorced wife to rescind a written agreement and to establish his interest in certain real and personal property, on the ground that there was no showing as required by Code of Civil Procedure, section 564, subdivision 1, that the property in dispute is in danger of being lost, removed, or materially injured.
