CARR, District Judge.

This is a ease in which plaintiff alleges that defendants violated provisions of the Lanham Act, 15 U.S.C. § 1051, the Sherman Act, 15 U.S.C. §§ 1-2, the common law, and Ohio statutory law, and seeks declaratory judgment under the Federal Declaratory Judgment Act, 28 U.S.C. §§ 2201-02. Specifically, plaintiff claims that defendants conspired to abuse their rights as trademark holders and otherwise restrain trade.
