This is an action for damages for personal injuries alleged to have been suffered by reason of the negligence of defendant. A demurrer was sustained to plaintiff’s second amended complaint, and judgment went for defendant. This is an appeal by plaintiff from such judgment.
The complaint contained two counts. Facts shown by each are as follows: Defendant was the owner of a rock crusher, which it was operating.
