This action was brought to obtain a decree establishing that all of the property possessed by Hyppolite Dutard at the time of his death was the property of the estates of his deceased father and mother, Bernard Dutard and Joaquina Dutard, held in trust by him for their heirs at law. The plaintiffs are a brother and sister of said Hyppolite Dutard, and the said sister is administratrix of the estates of the father and mother. The sister claims, as heir at law, to be the beneficial owner of an undivided one-fifth part of said property. The defendants are the executors of the will of said…
