These two actions were tried together before a jury, which returned a verdict in each case for the plaintiffs. The defendant has appealed on typewritten transcripts and both appeals are presented on the same set of briefs.

The plaintiffs were passengers on a stage operated by the defendant on the main highway designated as El Camino Real running through the city of San Mateo. Both plaintiffs were injured when the stage upon which they were riding was struck by a Buick automobile driven by Milton Hamilton at the intersection of El Camino Real with El Cerito Avenue.
