This action was brought by the plaintiff, a savings bank now in liquidation, to recover twenty-five thousand dollars and interest upon a promissory note, in words and figures as follows:

“$25,000. San Diego, Cal., November 11,1891.
“One year after date, without grace, for value received, we promise to pay to the order of Savings Bank of San Diego County, at their banking-house in the city of San Diego, the sum of twenty-five thousand dollars, with interest thereon from this date until payment at the rate of ten per cent per annum, payable quarterly, and if not so paid then to become part of the…
