This is an action to condemn a right-of-way in fee for state highway purposes. The only point in controversy is the matter of participation in the compensation award incident to the state’s exercise of its right of eminent domain. The trial court adjudged the entire damage recovery in favor of the defendants Northwestern Pacific Railroad Company and City Bank Farmers Trust Company, and de creed the interest in the condemned property asserted by the defendant Blerding to be noncompensable.
