Before a general court-martial sitting in Korea, the accused faced charges alleging sodomy, in violation of Article 125 of the Uniform Code of Military Justice, 50 USC § 719, and assault with intent to commit sodomy, in violation of Article 134, 50 USC § 728. Convicted of the former offense only, he was sentenced to receive a dishonorable discharge, and to total forfeitures and confinement at hard labor for five years.
