I. INTRODUCTION
This case comes before the court on the defendant’s motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6), or in the alternative, for summary judgment pursuant to Federal Rule of Civil Procedure 56. The plaintiff alleges discrimination in violation of Title VII of the Civil Rights Act of 1964 (“Title VII”), 42 U.S.C. §§ 2000e et seq. and the Rehabilitation Act of 1973 (“the Rehabilitation Act”), 29 U.S.C. §§ 701 et seq.
