This action was brought to recover damages for personal injuries sustained by plaintiff in an elevator accident which occurred in the department store of the defendant in the city of Los Angeles. The elevator was operated by the defendant to convey passengers to and from the various floors of its department store. On April 6, 1912, plaintiff entered the elevator on the fifth floor to go to the third floor for the purpose of purchasing some curtains.
