The testimony in this case discloses the following facts: The plaintiff’s daughter was sick, and was taken to the depot of the defendant at the city of Pawhuska, accompanied by Dr. Speck, the plaintiff, and possibly one or two others, for the purpose of being carried as a passenger on the defendant’s train. When the train stopped, Dr. Speck advised the conductor that he had a sick patient whom he desired to put on the train, asked him if he could take her in at the rear door of the rear car, and also asked for time to put her on the train.
