The case at bar is a civil rights complaint filed pursuant to 42 U.S.C. § 1983 by plaintiff Willoughby, a Nevada prison inmate, against the warden of the Southern Nevada Correctional Center (“SNCC”) and three members of a disciplinary committee at SNCC.

This Court assigned the case to the United States Magistrate for all matters within her jurisdiction. Pursuant to that assignment, the Magistrate has submitted a Report and Recommendation advising this Court to deny the defendants’ motion for summary judgment as to Counts I and II in plaintiff’s complaint.…
