This case is presently before the Court upon the National Labor Relations Board’s (the Board’s) petition for enforcement of its order finding that Flex Plastics, Inc. (the Company) (1) violated § 8(a)(5) and (1) of the NLRA by withdrawing recognition from and refusing to bargain with the Union, (2) violated § 8(a)(1) by conditioning employee Virbel Swihart’s continued employment on her refraining from Union activity, and (3) violated §§ 8(a)(1), (2) and (5) by misleading its employees. The Company refutes these findings and contends that the Board’s order directing it to recognize and bargain…
