The plaintiff in error, who was plaintiff below, sought recovery of the possession of the lands described herein in .the district court of Craig county, together with rents, the petition being in the ordinary form in ejectment. After filing various pleadings, the case was submitted to the court for final determination upon an agreed statement of facts, the material parts of which are as follows:(1) “That one Richard Powell was enrolled upon the final rolls of the Cherokee Nation as No. 555, and of one-eighth Indian blood; that he died on or about April 26, 1903, leaving no…
